Welcome to KsaveraART. By accessing and using this website and purchasing our products, you agree to be bound by the following Terms of Service.

1. General Terms

By using this website, you confirm that you are at least 18 years old or have the consent of a parent or legal guardian.

We reserve the right to refuse or cancel an order in cases of suspected fraud, misuse of the website, or violation of these Terms, in accordance with applicable law.

2. Products and Pricing

  • All original paintings are unique, one-of-a-kind artworks. Due to the organic nature of hand-painted fine art, each original piece features individual brushstrokes, textures, paint layers, and subtle variations that are inherently impossible to replicate. These natural characteristics are a testament to authentic hand craftsmanship and ensure that no two original paintings are identical; therefore, minor differences between the physical artwork and its digital product photographs do not constitute a defect or misrepresentation.

  • All fine art prints are exclusive reproductions of original artworks designed by the artist Ksavera, created through a combination of diverse artistic and digital techniques. The artist retains all copyright and intellectual property rights to the images.

  • Prices are listed in EUR and include applicable VAT for EU customers, unless stated otherwise

  • Prices may be updated at any time; changes do not affect confirmed orders

  • Product images are presented as accurately as possible; however, colors, contrast, and textures may vary slightly due to individual screen settings, monitor calibrations, and ambient lighting conditions. Such minor variations do not constitute a manufacturing defect or product misrepresentation. Since all items are strictly made-to-order, custom size and color preferences do not qualify for returns, refunds, or exchanges.

3. Orders and Payment

  • All orders are subject to acceptance and availability

  • Payment must be received in full before an order is processed and shipped

  • Payments are securely processed via Shopify Payments (credit cards, debit cards, and other available methods)

  • Customers are responsible for providing accurate billing and shipping information

4. Shipping and Delivery

  • Shipping times are estimates and may vary depending on destination and customs procedures

  • For consumers within the EU, the risk of loss or damage passes to the customer only upon physical receipt of the goods. For B2B deliveries or deliveries outside the EU, risk transfers upon handover to the carrier, in accordance with applicable law.

  • If a delivery fails because the customer provided an incorrect shipping address or failed to collect the package from the pickup point, the customer shall bear all costs for re-shipping.

  • We are not responsible for delays caused by shipping carriers, customs authorities, or force majeure

  • Any customs duties, import taxes, or local fees are the responsibility of the customer

  • International orders may be subject to local import, customs, or environmental regulations (including EPR) in the destination country. Any compliance, recycling fees, or local processing requirements are the sole responsibility of the customer (importer).
  • Due to the large dimensions of many fine art prints and paintings, customers are responsible for ensuring that the delivery address can accommodate oversized shipments and that they are available to receive the package from the carrier.
  • LUCID Compliance & Upcycled Packaging: To achieve full environmental compliance with the German Packaging Act (Verpackungsgesetz - VerpackG) and the LUCID registry, shipments within Germany utilize eco-friendly, upcycled, and securely reused secondary cardboard boxes (reused shipping packaging). Under statutory exemptions, these pre-circulated materials have already been licensed in the dual system by previous distributors, thus reducing carbon footprint and resource consumption. The aesthetic appearance of the outer shipping box does not reflect the state of the contents; all artworks and prints inside are brand new and pristine. Claims or refund requests based strictly on the secondary nature or minor exterior wear of the shipping carton are legally groundless and will be rejected.

Made-to-Order Policy & No Right of Withdrawal (EU Consumers)
Important Notice regarding Fine Art Prints: All fine art prints available on this website (including acrylic, metal,  canvas and other variations) are strictly made-to-order. They are individual productions manufactured tailored specifically to the customer's choice of size, material, and specifications.
Exceptions to the Right of Withdrawal: In accordance with statutory provisions under EU and German Consumer Law (Section 312g Paragraph 2 No. 1 of the German Civil Code - BGB), the 14-day right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer’s specifications or are clearly personalized. 
Therefore, because all our prints and custom original artworks are individually made-to-order, ALL SALES ARE FINAL. No cancellations, returns, or exchanges are accepted once production has commenced, except in cases of manufacturing defects or transport damage verified upon delivery.

6. Intellectual Property

  • All artworks, images, texts, and content on this website are protected by copyright and intellectual property laws

  • The purchase of an artwork or print does not transfer any copyright or reproduction rights

  • Any reproduction, distribution, or commercial use without prior written permission is strictly prohibited

7. Limitation of Liability

To the extent permitted by law, KsaveraART shall not be liable for indirect or consequential damages arising from the use of this website or the purchase of products.


This limitation does not apply in cases of intent, gross negligence, injury to life, body, or health, or where liability is mandatory under applicable law (e.g., German Product Liability Act / Produkthaftungsgesetz).

8. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Federal Republic of Germany and applicable European Union law. If you are a consumer residing in the EU, this choice of law does not deprive you of the protection afforded by the mandatory consumer protection provisions of your country of residence.
The place of jurisdiction, where legally permissible, is Germany.

9. Privacy

The processing of personal data is governed by our Privacy Policy, which complies with the EU General Data Protection Regulation (GDPR).

10. Changes to These Terms

We reserve the right to update these Terms of Service at any time.
Changes will be published on this page with an updated revision date. Continued use of the website constitutes acceptance of the revised terms.

12. Consumer Rights (EU)

Nothing in these Terms affects your statutory consumer rights under EU law, including the right of withdrawal within 14 days of receiving goods, where applicable.

Please note: the right of withdrawal does not apply to custom-made or made-to-order original artworks and prints

The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at: https://europa.eu. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
